Trademark Registration in the UK

trademark registration in the UK

If you plan to open a business in the United Kingdom, you will need to register your trademark in this country. EXIP experts explain the best way to do this in a new article.

First, it is important to understand that trademark registration in the UK gives you exclusive rights to use the mark for your services or goods in this country. In that case, anyone who uses your trademark unlawfully will be held liable, and in some cases, criminally.

Second, a trademark registered in the UK is property that can later be sold or licensed for a fee (royalties). Therefore, registering a trademark in England can become a kind of investment that brings income if the business is successful.

The UK trademark registration process has two stages:

  1. Preparatory: analysis and checking of your trademark for identity with existing marks
  2. Filing the trademark application with the UK Intellectual Property Office

If your trademark passes the check, you will need to provide the following information:

  • Details of the trademark, the class, a description of the services or goods, and whether the mark includes a logo
  • Information about the applicant. For an individual, personal details; for a legal entity, detailed information about the company

Lawyers prepare all the necessary documents for you and file them with the UK Intellectual Property Office. The review period for a trademark application in England is 3 months. If no one challenges your right to the trademark, the decision will be published in the Trade Marks Journal and on the UK Intellectual Property Office website (updated every Friday).

A UK trademark registration certificate is valid for 10 years, after which it must be renewed.
